Soul & Surf Sri Lanka – Surf School Terms & Conditions

1. Surf Lessons & Equipment Rental
   All water activities involve inherent risks. The ocean contains natural hazards and wildlife of which you, the guest, must be aware. You agree to follow all instructions on safe use of surfboards and equipment.

• While Soul & Surf will take reasonable safety precautions, you confirm you are of sound mind and body to participate in recreational water activities, including surfing.
• You agree to use all provided equipment (surfboard, rash vest, leash, etc.) with care. Soul & Surf accepts no liability for injury, death, loss, or damage resulting from participation in activities, except where caused by gross negligence of Soul & Surf.
• Personal accident insurance is included in lessons unless injury or damage is caused by neglect or misconduct on your part. In such cases, you are responsible for repair or replacement costs of equipment.
• Neglect or misconduct includes but is not limited to:
  • Use of soft boards outside white water zones unless directed by an instructor.
    
  • Use of hard boards inside white water zones unless directed by an instructor.
    
  • Walking or sitting on the surfboard when upside down (fins facing upward).
    
  • More than one person sitting or walking on the same board simultaneously.
    
  • Dragging surfboards or wetsuits on rough surfaces.
    
  • Intentional damage to equipment.
    
  • Failure to follow safety instructions from qualified instructors during lessons.
    
• Charges for Damaged Equipment
  You will be liable for repair or replacement costs of any damaged equipment caused by neglect or misconduct. These charges will be communicated promptly and must be settled before further services.

2. Kid’s Policy
   Safety is paramount, especially with children. Instructors will operate within their professional qualifications and guidelines.

• Under 7 years: No lessons or surf guides available.
  
• Ages 7 to 12: Lessons offered if swimming ability is demonstrated. One parent or guardian must be in the water supervising at all times (cannot participate in the same lesson).
  
• Ages 12 to 16: Lessons offered with a parent or guardian supervising on the same beach; guardians may join the lesson.
  

3. Bookings

• By booking, you confirm you have read, understood, and agree to be bound by these Terms & Conditions. You also confirm you are over 18 or booking on behalf of someone who meets age requirements.
• You must have valid travel insurance covering water sports (surfing, paddle boarding, canoeing, etc.). Soul & Surf is not responsible for any costs from failure to hold such insurance.
• Surf conditions vary and are unpredictable. Soul & Surf is not liable for unsuitable surf conditions or cancellations due to weather or ocean safety.

4. Cancellation & Changes

• Your booking is non-refundable unless we cancel the lesson or no surf instructor is available.
  
• A non-refundable payment is required at the time of booking, paid to Adventure Bureau Ltd. 
  

5. Group Lessons & Minimum Numbers

• Group lessons require a minimum of 2 and a maximum of 6 participants.
  
• Bookings for group lessons can be made up until 3:00 PM the day before the lesson. Bookings made after 3:00 PM will be scheduled for the following day.
  
• If minimum numbers are not met, lessons may be cancelled or converted to private lessons.
  
• Soul & Surf reserves the right to cancel group lessons due to insufficient demand up to 12 hours before the scheduled start time.
  
• Customers will be offered alternative arrangements or a full refund if lessons are cancelled due to insufficient demand.
  

6. Health & Fitness

• You are responsible for ensuring your physical fitness for activities. Consult your doctor if unsure.
  
• Please disclose any medical conditions or disabilities at booking. Soul & Surf reserves the right to refuse participation if conditions pose risks.
  
• Failure to disclose relevant health info may result in cancellation without refund if participation is deemed unsafe.
  

7. Your Responsibilities & Behaviour

• You accept liability for any damage caused by you or your party and agree to cover repair or replacement costs.
  
• Disruptive, unsafe, or abusive behaviour may result in termination of lessons without refund or compensation.
  
• If lessons are terminated for behavioural reasons, you remain responsible for full payment.
  

8. Complaints

• Any issues must be raised immediately during the lesson to allow resolution.
  
• Unresolved complaints should be emailed to surf.srilanka@soulandsurf.com within 28 days.
  
• Late claims will not be accepted.
  

9. Equipment Rental

• Board rental is subject to availability. Only premium boards are available for rental.
  
• Late return of rental equipment will incur a fine of 2,000 LKR per hour past the agreed return time.
  
• If the board is booked by another customer on the same day, the late return fee will be the full day’s rental cost (5,000 LKR) in addition to any hourly penalties accrued.
  

10. Photography & Media Release
    By booking and participating in activities, you consent to Soul & Surf using photos or videos taken during lessons or events for promotional or marketing purposes, unless you notify us otherwise in writing prior to participation.
11. Force Majeure
    Soul & Surf will not be held liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to weather, natural disasters, political unrest, or government restrictions.
12. Data Protection
    Personal data collected during booking will be processed in accordance with applicable data protection laws and used solely for booking and service delivery purposes.
13. Governing Law
    These Terms & Conditions are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
